These Terms of Service govern your use of mywebsitedeals.com and any services provided by MyWebsiteDeals (“we”, “us”, “our”), owned and operated by Andrea L. Schellhause, 8764 Stoneyway Ct, Pickerington, OH 43147, USA.
1. Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use of the Site.
2. Services
Specific terms for each engagement (scope, fees, timelines, deliverables) are set out in a separate written proposal or statement of work. Those terms control in case of any conflict with these general Terms.
3. Payment
Unless otherwise agreed in writing, projects require a non-refundable deposit before work begins, with the balance due at launch. Care plans and ad-management retainers are billed monthly in advance. Late payments incur 1.5% interest per month.
4. Intellectual property
Once final payment is received, you own all custom design and content we create for you. We retain ownership of underlying tools, frameworks and code libraries, and we may showcase non-confidential work in our portfolio unless you ask us not to.
5. Refunds
If you are not happy with the first round of design mockups, you may cancel the project and receive a refund of any amounts paid minus a $390 concept fee.
6. Warranties & disclaimers
The Site and our services are provided “as is” without warranties of any kind. We do not guarantee specific search rankings, ad results or revenue outcomes.
7. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Site or our services is limited to the amount you have paid us in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold us harmless from any claims arising out of your use of the Site or your breach of these Terms.
9. Governing law
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. Any disputes will be heard in the state or federal courts located in Franklin County, Ohio.
