These Terms of Service ("Terms") govern your access to and use of mywebsitedeals.com and any services provided by MyWebsiteDeals, owned by Robert Garibay ("we", "our", "us"). By using our website or engaging our services, you agree to these Terms.
We provide web design, web development, ecommerce, SEO and website maintenance services. The specific scope, deliverables, timeline and fees for any engagement are described in a written proposal or statement of work signed by both parties.
Unless otherwise agreed in writing, projects require a 50% deposit before work begins and the balance upon delivery. Care plan and hosting fees are billed monthly in advance. Invoices are payable within 15 days. Late payments accrue interest of 1.5% per month.
You agree to provide accurate information, timely content and reasonable feedback. Delays caused by missing content or feedback may extend the project timeline. You warrant that any content you supply does not infringe third-party rights.
Upon full payment, you own the final website files, design and content we deliver. We retain the right to display the completed work in our portfolio and marketing materials, unless you request otherwise in writing.
Our work may integrate third-party services (hosting, payment processors, plugins). Your use of those services is governed by their own terms; we are not responsible for their availability or actions.
We warrant that services will be performed in a professional and workmanlike manner. To the maximum extent permitted by law, we disclaim all other warranties and our total liability for any claim is limited to the fees paid to us in the twelve months preceding the claim. In no event are we liable for indirect, incidental or consequential damages.
Because our work is custom, deposits are non-refundable once work begins. If we cannot deliver as promised, we will refund any unearned portion of your payment.
Either party may terminate an engagement with 14 days' written notice. You will pay for all work completed and expenses incurred up to the termination date.
These Terms are governed by the laws of the State of Texas, USA. Any dispute will be resolved in the state or federal courts located in El Paso County, Texas.
